Nyikina Mangala
Claim status: Active.
A meeting was held late 2011 to successfully change the named applicant after the State Government raised concerns that the claim is ‘flawed’.
Claim history:
The Nyikina Mangala claim was lodged with the National Native Title Tribunal in 1999 and covers about 27,000 square kilometers of land.
The Nyikina Mangala claim was delayed due to the speedy progress of the Noonkanbah determination, which is also on Nyikina Mangala country. However, in the interim, the Shire of Derby, West Kimberley developed an Indigenous Land Use Agreement with Nyikina Mangala Traditional Owners.
ILUA
The Indigenous Land Use Agreement, which was signed in October 2005, covers the entire claim area and sets out a process the shire has to follow in regards to new activities including the development of routine and new road works. It also sets out a protocol for managing Aboriginal cultural heritage issues when carrying out such work.
Connection Report
A connection report, showing how the Nyikina Mangala people have retained their connection to country since the colonisation of Australia, has been submitted to the State Government of Western Australia and is currently under assessment.
Following the State Government’s advice that the claim was ‘flawed’, the named applicants on the claim have been changed and further senior legal advice has been sought on how to address the State Government’s concerns.
